Please read these Terms of Service ("Terms") carefully before using the website operated by Samui Housing ("we", "us", or "our") at https://samuihousing.com (the "Service").

By accessing or using the Service you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

1. Eligibility

You must be at least 18 years of age to use this Service. By using the Service you represent and warrant that you meet this requirement and that your use complies with all applicable laws and regulations in your jurisdiction.

2. User Accounts

• You must provide accurate, current, and complete information when registering an account.
• You are responsible for safeguarding your password and for all activity that occurs under your account.
• You must notify us immediately at info@samuihousing.com of any unauthorised access or suspected breach of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for extended periods.
• You may not create accounts using automated means or under false pretences.

3. Property Listings

3.1 Listing Standards

When submitting a property listing, you agree that:

• All information provided (price, size, location, amenities, photos) is accurate and truthful.
• You have the legal right to advertise the property (e.g., as owner, authorised agent, or landlord).
• Photos are your own or you hold a licence to use them.
• The listing does not infringe any third-party intellectual property rights.
• The listing does not contain misleading, offensive, or illegal content.

3.2 Moderation

All listings are subject to review and approval by our team before publication. We reserve the right to reject, edit, or remove any listing at our sole discretion without prior notice. Common reasons for rejection include inaccurate information, prohibited content, duplicate listings, or suspected fraud.

3.3 Prohibited Listings

The following are strictly prohibited:

• Properties involving illegal activity or illegally constructed structures.
• Time-share schemes or multi-level marketing offers.
• Listings designed to harvest personal data from enquirers.
• Duplicate or "ghost" listings created to gain unfair visibility.

4. Memberships & Payments

4.1 Membership Plans

Certain features (such as increased listing limits or featured placement) require a paid membership. Membership fees are displayed at the time of purchase and are charged in Thai Baht (THB) unless otherwise stated.

4.2 Payment Processing

Payments are processed securely by PayPal. By making a payment you agree to PayPal's User Agreement and Privacy Policy. We do not store your card or bank account details.

4.3 Refunds

Membership fees are non-refundable except where required by applicable law or where we have materially failed to deliver the service. If you believe you are entitled to a refund, contact us within 7 days of the charge.

4.4 Membership Expiry

Memberships are for a fixed term as stated at purchase. They do not renew automatically unless explicitly offered as an auto-renewal option. Upon expiry, any features exceeding the free tier will be deactivated.

5. Intellectual Property

The Service and its original content (excluding user-submitted listings), features, and functionality are and will remain the exclusive property of Samui Housing. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

By submitting a listing or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and promote that content on the Service and in marketing materials for as long as the listing is active. You retain ownership of your content.

6. Disclaimer of Warranties

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Any listing information provided by third-party users is accurate, complete, or up to date.
• Properties advertised on the platform are legally available or that the advertiser has authority to rent or sell them.

Samui Housing is a listing platform, not a real estate agent or broker. We do not participate in, nor are we a party to, any transaction between buyers, sellers, landlords, and tenants. Any property transaction is solely between the parties involved.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Samui Housing shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or relating to:

• Your use of or inability to use the Service.
• Any content or conduct of any third party on the Service.
• Any property transaction or dispute with a landlord, seller, or buyer.
• Unauthorised access to or alteration of your data.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Scrape, crawl, or data-mine the Service without our written permission.
• Upload or distribute malware, viruses, or any other harmful code.
• Attempt to gain unauthorised access to any part of the Service or its underlying systems.
• Harass, threaten, or harm other users of the Service.
• Post spam, unsolicited advertisements, or chain letters.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the integrity or performance of the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to the collection and use of your data as described therein.

10. Third-Party Links & Services

The Service may contain links to third-party websites or services that are not owned or controlled by Samui Housing. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policy of any third-party site you visit.

11. Indemnification

You agree to defend, indemnify, and hold harmless Samui Housing and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason — including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time by contacting us.

Provisions that by their nature should survive termination (including Sections 5, 6, 7, 9, and 11) shall survive.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Service shall first be subject to good-faith negotiation between the parties. If the dispute is not resolved within 30 days, it shall be submitted to the competent courts of Surat Thani Province, Thailand.

Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated via a notice on the site or by email to registered users. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Samui Housing regarding the Service and supersede all prior agreements and understandings.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
